I, J. W. Patty of Noxubee County State of Mississippi being of sound and disposing mind and understanding but mindful of approaching desolation and willing to commit my body to earth and my spirit to God who gave it, do make, ordain and declare this to be my Last Will and Testament to wit.
Item 1. I will and desire that all my just debts be promptly paid.
Item 2. I give and bequeath to my son Robert C. Patty my gold watch and chain and to my son Joseph L. my breach loading shot gun fixtures and ammunition chest.
Item 3. I will and desire that the residue of my Estate of every description whatsoever be distributed as follows, a one fifth part each, to my sons, Robert C., John W. & Joseph L. Patty and my daughter Nancy E. Jones, and the remaining one fifth part paid to my said son R. C. Patty as trustee for the benefit of the children of my son Thomas T. and the said R. C. Patty shall manage and control same without bond or security until such sum as he may see fit & proper to deliver the same to my said son Thomas T. or his children and then his trust shall cease.
Item 4. I hereby constitute and appoint my son, Robert C. Patty guardian of the person and estate of my son Joseph L. without bond or security and direct that he shall never be required to make a report to any Court of his Guardianship
Item 5. I hereby constitute and appoint my son R. C. Patty and my son-in-law W. M. Jones as executors of this my last will and testament, they nor neither of them shall never be required to give bond or security, nor to report to any Court whatever. I hereby empower my said executors to do any and all things necessary to the full and final administration and settlement of my Estate without the directions, intervention or assistance of the Chancery Court. In testimony whereof I have hereunto set my hand and seal. This the 17th day of September A D 1883 hereby revoking all former wills made by me at any time. J. W. Patty ?
